Terms of sale
The agreement between you and Plantovia when you place an order.
Refunds, dead-on-arrival plants and returns have their own page, because that is the page people actually need: Refund, Return and Live Arrival Policy. It forms part of these terms.
1. Who you are buying from
Plantovia is a registered Ontario business name operated as a sole proprietorship by Liudmyla Koblytska. In these terms, "we", "us" and "Plantovia" mean that person, who is the seller and the party you are contracting with.
2. Who can order
By placing an order you confirm that you are able to enter into a binding contract — that you have reached the age of majority in Ontario, or are ordering with the involvement of a parent or guardian who accepts these terms on your behalf.
An account is required. Orders are tied to the email address on the account so that you can look them up later and so that we know who to send a receipt to.
3. Where we deliver, and pickup
Plantovia delivers to Mississauga, Etobicoke, Brampton, Oakville and Milton, Ontario, and nowhere else. Wherever you live, you can instead collect your order free from our pickup point in Mississauga; section 7 explains how.
Every delivered order goes out as a local same-day courier run rather than as a shipped parcel, because live aquatic plants do not survive a longer trip. Checkout verifies your postal code against the serviced areas before an order can be submitted. An address outside those areas cannot be fulfilled — not for an extra fee, and not by arrangement.
If an order is somehow placed for an address we cannot reach, we will cancel it and refund it in full.
4. Prices and what you pay
4.1 Plant and product prices
Prices are in Canadian dollars and are the prices shown on the site at the moment you place your order.
4.2 Delivery and pickup
Pickup is free. Delivery is charged per city, at a flat rate, and each city's rate is shown on the delivery page as soon as you choose it. Mississauga — and only Mississauga — has free delivery once your subtotal reaches the threshold displayed at checkout, because it is the city we are already driving through. Every other city is a dedicated run whose cost does not fall away as the basket grows.
Current rates and the free-delivery threshold are always the ones shown at checkout. Where a promotion mentions free delivery, the condition attached to it will be stated alongside it.
4.3 Tax
HST is charged at 13% on your order. Plantovia is registered for GST/HST under registration number 796740603RT0001, and remits the tax it collects to the Canada Revenue Agency.
The tax appears as its own line in your cart and again on the payment page, so you see it before you commit rather than only on the receipt. Your receipt shows the amount of HST charged and our registration number.
4.4 The total is the total
The amount shown on the payment page before you submit is the full amount due: items, plus delivery if you chose it, with nothing added afterwards. No fee is charged at the door or at pickup, and the courier will never ask you for money.
5. Payment
Plantovia accepts Interac e-transfer only. No card is taken, and no payment details are ever entered on this site.
- Submit your order. An order number appears on screen and is emailed to you.
- Send the exact total by e-transfer to plantovia.shop@gmail.com, putting your order number in the transfer message.
- Your order is prepared once the transfer has arrived, and then a courier is booked or, for pickup, we text you that it is ready to collect. A pickup order is never handed over before it is paid.
Submitting an order does not on its own reserve stock. Plants are set aside when payment clears, so an item can sell out between your order and your transfer. If that happens we will contact you and either substitute with your agreement or refund that item in full.
If the transfer never arrives. An unpaid order is held for three business days and then cancelled automatically. Nothing is owed and nothing is charged — the order simply lapses, and you are free to place it again. If you need longer, tell us and we will hold it.
A transfer sent without an order number, or for the wrong amount, will delay your order until we can match it up. If we cannot match a transfer to an order at all, we will return it.
6. Delivery
6.1 How it works
Your order is delivered by an Uber Courier driver, not a mail carrier. Uber texts the tracking link, the delivery updates and, on some runs, a handoff code to the phone number on your order. Keep that phone with you during your window, and make sure the number is right — a wrong number is the single most common way a delivery fails.
6.2 Someone has to be there
This is a condition of the sale, not a suggestion. Live plants cannot be left unattended — not on a porch, not with a concierge, not in a lobby — because a box of aquatic plants left in a Canadian summer or winter is a box of dead plants. You confirm this at checkout before you submit.
You come outside to meet the driver once the tracking shows they have arrived. In an apartment or condo, come down to the lobby or building entrance; drivers generally will not come up to a unit.
6.3 If the delivery fails
If the driver arrives within your chosen window and nobody is available to receive the order, or the phone number on the order cannot be reached, the delivery has failed. In that case:
- We will contact you and arrange a second run on the next available day.
- A second courier run is charged at your city's delivery rate, because it is a second trip made for one order. You pay it by e-transfer before the run is booked.
- Plants that did not survive the failed attempt are replaced at our cost on that second run, not charged again.
- If you would rather not go ahead, we will refund the items and the original delivery fee, less any plants that cannot be resold after a full day out.
If a delivery fails for a reason on our side — the wrong address was entered by us, the courier never arrived, the window was missed — the second run costs you nothing.
6.4 Changing or cancelling
You can change your delivery details, move the date, or cancel outright at no charge any time before your order is packed, by replying to your order email. Once packed, cancellation is handled under the refund policy.
7. Pickup
Instead of delivery you can collect your order yourself. Everything in this section applies to pickup orders only; everywhere else in these terms, "delivery" includes handing an order over at pickup.
7.1 Where and when
Orders are collected from 3170 Golden Orchard Dr, Mississauga, ON L4Y 3G8. Pickup is free. At checkout you choose a day, from today up to seven days ahead, and a time window. The window is when you expect to arrive, not an appointment to the minute — if you are running early or late, text us.
Some days or windows may be unavailable, for example on holidays or when a window is already fully booked. Checkout only offers the ones that are open.
7.2 Pay before you collect
This is a condition of the sale. A pickup order must be paid in full by e-transfer before it is handed over, and you confirm this at checkout before you submit. An order whose payment has not arrived is not released, whoever comes to collect it. An unpaid pickup order lapses under section 5 in the same way as any other.
7.3 The handover
- Once your payment has arrived and your order is packed, we text the phone number on your order to confirm your pickup.
- When you arrive, text the store number given in your order confirmation email. We bring your order down to the lobby of the building; customers do not come up to a unit.
- If we cannot reach you, or you do not arrive in your window, we will text you to arrange another time.
7.4 Who can collect
You, or anyone you send. We hand the order to whoever gives us its order number, so treat that number like a ticket and share it only with the person collecting. Once an order has been handed to someone who gave the correct order number, it counts as collected.
7.5 Checking your plants
Look over your plants in the lobby when you collect them, and tell us there if anything is wrong — it is the quickest way to put it right. The 48-hour live-arrival window in the refund policy runs from the time of pickup, in place of the time of delivery.
7.6 If you cannot come
Text us, or reply to your order email, and we will move your pickup to another day at no charge. If a paid order is not collected and not rebooked, we hold it for three days after the pickup day you chose and try to reach you in that time. After that the order is cancelled and refunded in full by e-transfer, within five business days. The plants go back into our tanks, so a missed pickup costs you nothing.
7.7 Changing or cancelling
You can change your pickup day or window, switch to delivery, or cancel outright at no charge any time before you collect, by texting us or replying to your order email. Switching to delivery adds your city's delivery rate, which you pay by e-transfer before the run is booked.
8. Stock, listings and pricing errors
The catalogue is maintained by hand and occasionally something is wrong: a price with a digit missing, a plant marked in stock that is not, a description that does not match what arrived from the grower.
Where an order has been placed against an obvious error, we may cancel it rather than fulfil it. If we do, we will tell you why and refund you in full within three business days — and if you would still like the item at the corrected price, we will offer it to you first.
Live plants vary. Size, leaf count and exact shade differ from the photograph, which shows a representative example rather than the individual plant you will receive. Plants are sold as the species named; we do not guarantee a specific size unless the listing states one.
9. Your responsibilities as a buyer
- Give a correct, reachable phone number and, for delivery, a complete address.
- Be available during the window you chose, or come to collect in it, or tell us in advance that you cannot.
- Unpack and acclimatise your plants promptly — the same day is best. Plants left boxed will not survive, and that is outside what the refund policy covers.
- Check that a plant suits your tank before you order. We will happily advise if you ask first.
10. Live plants: what we do not warrant
We warrant that plants leave us healthy, correctly identified and in good condition, and the Refund, Return and Live Arrival Policy sets out exactly what to do if yours did not arrive that way.
Beyond that point we cannot warrant an outcome, because the outcome is your aquarium. We do not guarantee that a plant will thrive in any particular tank, that it will not melt back after planting (which is normal for many species and usually temporary), or that it is compatible with your livestock, lighting, substrate or water chemistry.
Plants are sold for use in aquariums. They are not food, not medicine, and not intended for consumption by people or animals.
11. Limitation of liability
Nothing in these terms limits any right you have under Ontario's Consumer Protection Act, 2002 or the Sale of Goods Act, and nothing here excludes liability for death, personal injury or anything else that cannot be excluded by law. Those rights sit above this section.
Subject to that: our total liability arising out of any order is limited to the amount you paid for that order.
We are not liable for indirect or consequential loss — in particular, loss of aquarium livestock, damage to a tank or its equipment, algae outbreaks, snails or other hitchhikers introduced with plants, or the cost of treating any of it. Quarantining and inspecting new plants before they enter an established tank is the buyer's responsibility, and we recommend it every time.
We are not responsible for delays or failures caused by things outside our reasonable control, including weather, road closures and courier availability.
12. Your account
Keep your password to yourself; you are responsible for what is done through your account. Tell us at once if you think someone else has access to it. We may suspend or close an account that is used fraudulently, or to place orders there is no intention of paying for.

13. These terms
These terms, together with the refund policy and the privacy policy, are the whole agreement between you and Plantovia for your order.
The version that applies to your order is the version you accepted when you placed it. That version number is recorded against your order and printed on your receipt, so it can always be identified — a later edit to this page does not change the deal you made.
If any part of these terms turns out to be unenforceable, the rest continues to apply.
14. Governing law
These terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply in it. The courts of Ontario have jurisdiction over any dispute, and nothing here prevents you from bringing a claim in the Ontario Small Claims Court or from complaining to Ontario's Ministry of Public and Business Service Delivery.
Before you order
The refund page answers what happens if plants arrive in poor condition. It is worth two minutes.
